  • Trimble v. Farmers Ins. Group Inc., Case No. 80CV3143, Jefferson County District Court, State of Colorado. Appeal to the Colorado Supreme Court established the tort of bad faith breach of insurance contract. Allows an insured to bring an action against his/her liability insurers for damages in excess of policy benefits for unreasonable handling of suits against an insured.
  • Beef Partnership Inc. v. Miller's Mutual Insurance Co., Case No. 87-CV-760, Denver County District Court, State of Colorado. Jury verdict in the amount of $923,000, plus an additional $700,000 in attorney's fees and costs on behalf of an owner for bad faith breach of insurance contract.
  • Murphy v. Royal Maccabees Insurance Co., Case No. 96-2664, United States District Court for the District of Colorado. Jury verdict in the amount of $3,000,000 on behalf of Dr. David Murphy for bad faith breach of his disability insurance contract.
  • Lips v. American Cmty. Mut. Ins. Co., Case No. 96-774, United States District Court for the District of Colorado. Jury verdict in the amount of $600,000 in favor of Linda Lipps for bad faith breach of her health insurance policy.
  • Hall v. UNUM Provident Life Insurance Co., Case No. 97-1828, United States District Court for the District of Colorado. Judgment entered in favor of Russanne Hall on breach of contract claim for wrongfully refusing to pay disability benefits. See also Hall v. UNUM, 300 F. 3d 1197 (10th Cir. 2002).
  • Smith v. American Family Ins. Co., Case No. 01-CV-1799, Jefferson County District Court, State of Colorado. Judgment in the amount of $319,771, entered after jury verdict in favor of Barbara Smith for bad faith breach of her homeowners policy and violation of Colorado Consumer Protection Act.
  • Royal Maccabees Life Ins. Co. v. Choren, Case No. 99-1031, United States District Court for the District of Colorado. Jury verdict in the amount of $425,000 in damages and preservation of future stream of benefits several times this amount in favor of Dr. Choren for bad faith in handling his disability claim.
  • David Woodard v. Quality Choice Foods, LLC, Case No. 00-CV-2014, Boulder County District Court, State of Colorado. Jury verdict, in favor of David Woodard in the amount of $1,932,000, plus $450,000 in attorneys' fees for negligence, breach of fiduciary duty, and violations of the Colorado Consumer Protection Act in defendants' wrongful conduct in bringing Mr. Woodard's BBQ Rib product to market.
